The Arbitration Council Foundation Request for Expressions of Interest Consultancy for Studies on Mediation Service Market
  ACF seeks an experienced researcher or a research group to conduct studies on mediation service market   Background: The Arbitration Council (AC) of Cambodia is a national institution provided for under the Labour Law and mandated to resolve labour disputes. Supported by the Ministry of Labour and Vocational Training, employers and unions, the AC is internationally and nationally recognised as Cambodia’s premier labour dispute resolution body. The Arbitration Council Foundation (ACF) is an independent and non-political organization that supports the AC through fundraising, training & professional development of arbitrators, and dissemination of information on conciliation, arbitration, the Labour Law, and dispute prevention and resolution services. The roles of the AC and ACF are critical to improving the climate for investment, increasing economic growth and furthering social dialogues and development.   The above-mentioned labour law stipulates that the labour dispute can be referred to settle by any procedure agreed on by all the parties to the dispute, or other procedures under the law (Art. 309). This law also states that the procedure for conciliation and arbitration shall be carried out free of charge (Art.316), but the law is silent about a provision of mediation services. Therefore, fee-based services for mediation of labour and non-labour disputes are subject of investigation and analyses of the laws and practices.   The Consultancy: ACF looks for a researcher or research agency to conduct studies aiming to establish legal framework, provide analyses of market demand for fee-based mediation services, and analyses of mediation service operations.   Detailed Terms of Reference for the assignment is available at ACF Office or website at www.arbitrationcouncil.org or at the address as shown below, from 8:00 to 17:30. and from Monday to Friday, or can be obtained by a request via email to [email protected].   Qualification: Individual researcher or agency shall have the following qualifications and experience:   ♦ In case of NGOs or firms, valid registration is required. ♦ Knowledge of Cambodian laws and legal systems, especially in relation to labor dispute resolution, Cambodian industrial relations, legal organizations and institutions of justice will be an asset. ♦ Demonstrated experience relevant to research topics in designing and delivering similar economic or market survey work and other social research assignments. ♦ Proven records of professional research/writing achievements ♦ Master degree in business, law, social science or related fields with 8 years of experiences. ♦ Fluency in Khmer and English is required.   Application: Expressions of interest must provide detailed information indicating that qualifications to perform the services (description of similar assignments, experience in similar conditions, availability and organization profile/curriculum vitae of consultant/appropriate technical staff, etc.) Short listed candidates will be invited to submit a full proposal (including technical and financial proposal).
